3. Eligibility

Our services are designed for UK-based car dealerships and motor trade businesses. To use the Platform, you must be at least 18 years of age, have the legal authority to bind your business entity, and operate a legitimate motor trade business.

5. Subscription and Payment

Services are provided on a monthly subscription basis. The current fee is as stated on our website at the time of subscription. Payment is due monthly in advance. We reserve the right to change our pricing with a minimum of 30 days written notice. All fees are exclusive of VAT where applicable.

6. Your Content and Data

You retain full ownership of all content you upload to the Platform, including vehicle listings, images, customer data, and business information. You grant AutoDeck a non-exclusive, worldwide licence to use, store, and process this content solely for the purpose of providing our services. You are responsible for ensuring you have the right to use and share any content you upload.

7. Your Obligations

As a user of the Platform, you agree to:

Provide accurate and truthful information in all vehicle listings
Comply with the Consumer Rights Act 2015 and all applicable consumer protection legislation
Comply with UK GDPR and the Data Protection Act 2018 when handling customer data
Maintain the security of your account credentials
Use the Platform only for lawful purposes in accordance with our Acceptable Use Policy
Not attempt to reverse engineer, copy, or redistribute the Platform

8. AI Features Disclaimer

Our AI-powered features (chat agent, listing descriptions, lead qualification) are designed to assist your business operations. While we strive for accuracy, AI-generated content should be reviewed before publication. You are ultimately responsible for all content published through your dealership website and communications sent to your customers.

9. Limitation of Liability

To the maximum extent permitted by law:

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
We are not liable for indirect, consequential, incidental, special, or punitive damages
We are not liable for any loss arising from vehicle data inaccuracies provided by third-party services (DVLA, MOT, valuation providers)
We are not liable for lost profits, lost sales, or business interruption

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

Either party may terminate the subscription with 30 days written notice to support@autodeck.co.uk. We may suspend or terminate accounts that breach these Terms immediately and without notice in serious cases. Upon termination, you may request an export of your data within 30 days. After this period, your data will be deleted in accordance with our Privacy Policy.

11. Dispute Resolution

We encourage you to contact us first at support@autodeck.co.uk to resolve any disputes informally. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Governing Law

8. Enforcement

We reserve the right to investigate any suspected violation of this AUP. Where a violation is confirmed, we may take one or more of the following actions:

Temporarily suspend access to the Platform
Permanently terminate your account
Remove or disable offending content
Report the matter to relevant authorities where required by law

In cases of serious or criminal violations, we may take immediate action without prior warning.
